V&nbsp;\u010dl\u00e1nku se zab\u00fdv\u00e1m nadu\u017e\u00edv\u00e1n\u00edm v\u011bci spoluvlastn\u00edkem nad r\u00e1mec jeho spoluvlastnick\u00e9ho pod\u00edlu. Kdy m\u016f\u017ee druh\u00fd spoluvlastn\u00edk (ostatn\u00ed spoluvlastn\u00edci) \u017e\u00e1dat vyd\u00e1n\u00ed bezd\u016fvodn\u00e9ho obohacen\u00ed, a kdy n\u00e1hradu za omezen\u00ed spoluvlastnick\u00e9ho pr\u00e1va? A jak\u00e9 skute\u010dnosti mohou b\u00fdt pro p\u0159izn\u00e1n\u00ed n\u00e1roku kl\u00ed\u010dov\u00e9?&nbsp;<\/strong><\/p>\n\n\n\n<p>Spoluvlastnick\u00fd pod\u00edl vyjad\u0159uje m\u00edru \u00fa\u010dasti spoluvlastn\u00edka na vytv\u00e1\u0159en\u00ed spole\u010dn\u00e9 v\u016fle a na pr\u00e1vech a povinnostech vypl\u00fdvaj\u00edc\u00edch ze spoluvlastnictv\u00ed. Je to pomysln\u00e9 vyj\u00e1d\u0159en\u00ed omezen\u00e9ho pr\u00e1va k cel\u00e9 v\u011bci a ke ka\u017ed\u00e9 jej\u00ed \u010d\u00e1sti. Spoluvlastn\u00edk nen\u00ed v\u00fdlu\u010dn\u00e9 opr\u00e1vn\u011bn ke sv\u00e9voln\u00fdm dispozic\u00edm se spole\u010dnou v\u011bc\u00ed nebo jej\u00edmi re\u00e1ln\u00fdmi \u010d\u00e1stmi \u2013 proto je spoluvlastnick\u00fd pod\u00edl \u201eide\u00e1ln\u00ed\u201c.<\/p>\n\n\n\n<p>Spoluvlastnick\u00fd pod\u00edl je z\u00e1rove\u0148 v\u011bc\u00ed v&nbsp;pr\u00e1vn\u00edm smyslu. Jde o pr\u00e1vo spoluvlastn\u00edka, kter\u00e9 vzhledem k&nbsp;\u0161irok\u00e9mu pojet\u00ed v\u011bci v&nbsp;sou\u010dasn\u00e9 pr\u00e1vn\u00ed \u00faprav\u011b je samostatnou v\u011bc\u00ed, p\u0159edm\u011btem pr\u00e1vn\u00edch vztah\u016f. A takto s n\u00edm lze disponovat; lze ho nap\u0159. i zastavit, uspokojit z&nbsp;n\u011bj v\u011b\u0159itele p\u0159i v\u00fdkonu rozhodnut\u00ed \u010di exekuci, lze ho patrn\u011b i opustit.<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a><\/p>\n\n\n\n<p>V&nbsp;praxi m\u016f\u017ee nastat situace, kdy jeden ze spoluvlastn\u00edk\u016f u\u017e\u00edv\u00e1 spole\u010dnou v\u011bc nad r\u00e1mec sv\u00e9ho pod\u00edlu. Dejme tomu, \u017ee jsou dva spoluvlastn\u00edci bytov\u00e9 jednotky. V&nbsp;byt\u011b bydl\u00ed jeden z&nbsp;nich, druh\u00fd byt v\u016fbec neu\u017e\u00edv\u00e1. Prvn\u00ed ze spoluvlastn\u00edk\u016f tomu druh\u00e9mu nic neplat\u00ed. M\u00e1 druh\u00fd spoluvlastn\u00edk pr\u00e1vo na vyd\u00e1n\u00ed bezd\u016fvodn\u00e9ho obohacen\u00ed?<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a> &nbsp;&nbsp;<\/p>\n\n\n\n<p>Z&nbsp;judikatury v\u00edme, \u017ee \u201e<em>U\u017e\u00edv\u00e1-li spoluvlastn\u00edk bez pr\u00e1vn\u00edho d\u016fvodu (zejm\u00e9na bez rozhodnut\u00ed v\u011bt\u0161iny spoluvlastn\u00edk\u016f nebo bez dohody spoluvlastn\u00edk\u016f anebo bez rozhodnut\u00ed soudu) spole\u010dnou v\u011bc nad r\u00e1mec sv\u00e9ho spoluvlastnick\u00e9ho pod\u00edlu, je povinen vydat to, o\u010d se takov\u00fdm u\u017e\u00edv\u00e1n\u00edm obohatil, ostatn\u00edm spoluvlastn\u00edk\u016fm podle pravidel o vyd\u00e1n\u00ed bezd\u016fvodn\u00e9ho obohacen\u00ed (\u00a7 451 a n\u00e1sl. ob\u010d. z\u00e1k.)<\/em>\u201c<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a> (pozn. dnes \u00a7 2991 o.z.). Stejn\u011b tak judikatura z&nbsp;ned\u00e1vn\u00e9 doby uv\u00e1d\u00ed, \u017ee \u201e<em>upravuje-li soud u\u017e\u00edv\u00e1n\u00ed spole\u010dn\u00e9 v\u011bci s vylou\u010den\u00edm jednoho \u00fa\u010dastn\u00edka z u\u017e\u00edv\u00e1n\u00ed konstitutivn\u00edm rozhodnut\u00edm, nem\u016f\u017ee v z\u00e1sad\u011b opomenout vydat rozhodnut\u00ed o pen\u011b\u017en\u00ed n\u00e1hrad\u011b, kter\u00e1 bude poskytov\u00e1na a\u017e do z\u00e1niku bezpod\u00edlov\u00e9ho spoluvlastnictv\u00ed<\/em>\u201c.<a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Nadu\u017e\u00edv\u00e1n\u00ed v\u011bci na z\u00e1klad\u011b pr\u00e1vn\u00edho d\u016fvodu a bez pr\u00e1vn\u00edho d\u016fvodu<\/strong><\/h2>\n\n\n\n<p>Je t\u0159eba rozli\u0161ovat dv\u011b situace nadu\u017e\u00edv\u00e1n\u00ed v\u011bci spoluvlastn\u00edkem nad r\u00e1mec jeho pod\u00edlu.<a href=\"#_ftn5\" id=\"_ftnref5\">[5]<\/a><\/p>\n\n\n\n<p>1) Doch\u00e1z\u00ed-li k&nbsp;nadu\u017e\u00edv\u00e1n\u00ed v\u011bci spoluvlastn\u00edkem bez rozhodnut\u00ed v\u011bt\u0161iny spoluvlastn\u00edk\u016f, bez dohody spoluvlastn\u00edk\u016f o zp\u016fsobu u\u017e\u00edv\u00e1n\u00ed spole\u010dn\u00e9 v\u011bci a bez rozhodnut\u00ed soudu, jde o \u201e<strong>nedovolen\u00e9 nadu\u017e\u00edv\u00e1n\u00ed<\/strong>\u201c. Pak druh\u00e9mu spoluvlastn\u00edkovi (ostatn\u00edm spoluvlastn\u00edk\u016fm) vznik\u00e1 proti nadu\u017e\u00edvaj\u00edc\u00edmu spoluvlastn\u00edkovi pr\u00e1vo na vyd\u00e1n\u00ed bezd\u016fvodn\u00e9ho obohacen\u00ed dle \u00a7 2991 a n\u00e1sl. o.z.<\/p>\n\n\n\n<p>2) Pokud n\u011bkter\u00fd ze zm\u00edn\u011bn\u00fdch d\u016fvod\u016f existuje, p\u016fjde o \u201e<strong>dovolen\u00e9 nadu\u017e\u00edv\u00e1n\u00ed<\/strong>\u201c. Dohoda spoluvlastn\u00edk\u016f, dle kter\u00e9 fakticky u\u017e\u00edv\u00e1 v\u011bc jen jeden (\u010d\u00e1st) z&nbsp;nich, m\u016f\u017ee p\u0159itom b\u00fdt i konkludentn\u00ed.<a href=\"#_ftn6\" id=\"_ftnref6\">[6]<\/a> Zkr\u00e1cen\u00e9mu spoluvlastn\u00edkovi pak n\u00e1le\u017e\u00ed n\u00e1hrada za omezen\u00ed jeho spoluvlastnick\u00e9ho pr\u00e1va dle \u010dl. 11 odst. 4 Listiny z\u00e1kladn\u00edch pr\u00e1v a svobod a \u00a7 1117 ve spojen\u00ed s \u00a7 1122 odst. 1 o.z. &nbsp;<\/p>\n\n\n\n<p>N\u00e1hrada \u010di vyd\u00e1n\u00ed bezd\u016fvodn\u00e9ho obohacen\u00ed, nen\u00ed to jedno? Nikoli. T\u0159eba proml\u010dec\u00ed lh\u016fta u vyd\u00e1n\u00ed bezd\u016fvodn\u00e9ho obohacen\u00ed se proml\u010duje dle \u00a7 619, \u00a7 621 a \u00a7 638 o.z.<a href=\"#_ftn7\" id=\"_ftnref7\">[7]<\/a> Naopak n\u00e1hrada za \u201edovolen\u00e9 nadu\u017e\u00edv\u00e1n\u00ed\u201c se proml\u010duje v obecn\u00e9 lh\u016ft\u011b podle \u00a7 619 a 629 o.z.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Nedovolen\u00e9 nadu\u017e\u00edv\u00e1n\u00ed<\/strong><\/h3>\n\n\n\n<p>Ot\u00e1zkami u nedovolen\u00e9ho nadu\u017e\u00edv\u00e1n\u00ed v\u0161ak m\u016f\u017ee b\u00fdt 1) zda jeden ze spoluvlastn\u00edk\u016f skute\u010dn\u011b u\u017e\u00edv\u00e1 v\u011bc nad r\u00e1mec sv\u00e9ho pod\u00edlu, a 2) zda je druh\u00fd spoluvlastn\u00edk skute\u010dn\u011b vylou\u010den z u\u017e\u00edv\u00e1n\u00ed v\u011bci.<\/p>\n\n\n\n<p>Obecn\u011b toti\u017e m\u016f\u017ee nastat situace, \u017ee i kdy\u017e v\u011bc u\u017e\u00edv\u00e1 (nap\u0159. ob\u00fdv\u00e1) jen jeden spoluvlastn\u00edk, druh\u00fd spoluvlastn\u00edk m\u00e1 mo\u017enost tuto v\u011bc objektivn\u011b spoluu\u017e\u00edvat v rozsahu sv\u00e9ho pod\u00edlu. Takovou situac\u00ed, kdy spole\u010dnou v\u011bc\u00ed byla bytov\u00e1 jednotka, se ned\u00e1vno zab\u00fdval Nejvy\u0161\u0161\u00ed soud.<a id=\"_ftnref8\" href=\"#_ftn8\">[8]<\/a> Spoluvlastn\u00edk, kter\u00fd v jednotce fakticky bydl\u00ed, m\u016f\u017ee toti\u017e teoreticky u\u017e\u00edvat pouze jej\u00ed \u010d\u00e1st, kter\u00e1 v\u00fdm\u011brou, pop\u0159\u00edpad\u011b kvalitou u\u017e\u00edv\u00e1n\u00ed koresponduje jeho pod\u00edlu. Nejvy\u0161\u0161\u00ed soud dosp\u011bl k\u00a0n\u00e1zoru, \u017ee samotn\u00fd fakt, \u017ee jeden spoluvlastn\u00edk v\u011bc u\u017e\u00edv\u00e1, a druh\u00fd nikoli, nezakl\u00e1d\u00e1 pr\u00e1vo druh\u00e9ho spoluvlastn\u00edka na vyd\u00e1n\u00ed bezd\u016fvodn\u00e9ho obohacen\u00ed oproti tomu, kdo v\u011bc fakticky u\u017e\u00edv\u00e1. Je proto t\u0159eba zjistit, <strong>v jak\u00e9m rozsahu<\/strong> spoluvlastn\u00edk v\u011bc re\u00e1ln\u011b u\u017e\u00edval. V\u00a0p\u0159\u00edpad\u011b bytov\u00e9 jednotky nejenom co do v\u00fdm\u011bry, ale i kvality ob\u00fdvan\u00fdch prostor, se z\u0159etelem na dispozi\u010dn\u00ed uspo\u0159\u00e1d\u00e1n\u00ed jednotky. <a id=\"_ftnref9\" href=\"#_ftn9\">[9]<\/a><\/p>\n\n\n\n<p>D\u00e1le se zji\u0161\u0165uje, zda byly d\u00e1ny <strong>objektivn\u00ed p\u0159ek\u00e1\u017eky<\/strong> (a\u0165 u\u017e technick\u00e9ho r\u00e1zu, \u010di v&nbsp;podob\u011b faktick\u00fdch pom\u011br\u016f vytvo\u0159en\u00fdch jedn\u00edm ze spoluvlastn\u00edk\u016f), kter\u00e9 druh\u00e9mu spoluvlastn\u00edkovi br\u00e1nily v u\u017e\u00edv\u00e1n\u00ed jednotky v&nbsp;rozsahu odpov\u00eddaj\u00edc\u00edmu jeho pod\u00edlu.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>D\u016fkazn\u00ed b\u0159emeno ve sporu o vyd\u00e1n\u00ed bezd\u016fvodn\u00e9ho obohacen\u00ed za nedovolen\u00e9 nadu\u017e\u00edv\u00e1n\u00ed spoluvlastnick\u00e9ho pod\u00edlu<\/strong><\/h4>\n\n\n\n<p>Pokud n\u011bkter\u00fd spoluvlastn\u00edk hodl\u00e1 uplatnit pr\u00e1vo na vyd\u00e1n\u00ed bezd\u016fvodn\u00e9ho obohacen\u00ed, mus\u00ed po\u010d\u00edtat s&nbsp;t\u00edm, \u017ee jej coby ochuzen\u00e9ho t\u00ed\u017e\u00ed d\u016fkazn\u00ed b\u0159emeno ohledn\u011b<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>rozsahu \u201enadu\u017e\u00edv\u00e1n\u00ed\u201c spole\u010dn\u00e9 v\u011bci druh\u00fdm spoluvlastn\u00edkem, a pop\u0159. i ohledn\u011b<\/li>\n\n\n\n<li>technick\u00e9ho uspo\u0159\u00e1d\u00e1n\u00ed spole\u010dn\u00e9 v\u011bci nebo faktick\u00fdch pom\u011br\u016f vytvo\u0159en\u00fdch jedn\u00edm ze spoluvlastn\u00edk\u016f (faktick\u00fdm u\u017eivatelem v\u011bci), kter\u00e9 ochuzen\u00e9mu spoluvlastn\u00edkovi neumo\u017e\u0148uj\u00ed realizaci pr\u00e1va u\u017e\u00edvat spole\u010dnou v\u011bc v rozsahu ur\u010den\u00e9m jeho pod\u00edlem.<a id=\"_ftnref10\" href=\"#_ftn10\">[10]<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Z\u00e1v\u011br<\/strong><\/h2>\n\n\n\n<p>Co tedy z\u00a0nov\u00e9 judikatury Nejvy\u0161\u0161\u00edho soudu vypl\u00fdv\u00e1? Je to pomysln\u00e9 vyj\u00e1d\u0159en\u00ed omezen\u00e9ho pr\u00e1va k cel\u00e9 v\u011bci a ke ka\u017ed\u00e9 jej\u00ed \u010d\u00e1sti.
