V tomto \u010dl\u00e1nku si uk\u00e1\u017eeme, jak\u00e1 pr\u00e1va v\u00e1m d\u00e1v\u00e1 z\u00e1kon\u00edk pr\u00e1ce, jak funguje <strong>okam\u017eit\u00e9 zru\u0161en\u00ed pracovn\u00edho pom\u011bru<\/strong> a kdy m\u00e1te n\u00e1rok na <strong>n\u00e1hradu mzdy<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Nevyplacen\u00e1 mzda \u2013 co to pro zam\u011bstnance znamen\u00e1?<\/h2>\n\n\n\n<p>Pokud v\u00e1m zam\u011bstnavatel nevyplat\u00ed mzdu (nebo jej\u00ed \u010d\u00e1st, p\u0159\u00edpadn\u011b n\u00e1hradu mzdy) <strong>ani do 15 dn\u016f po splatnosti<\/strong>, m\u016f\u017eete podle \u00a7 56 odst. 1 p\u00edsm. b) z\u00e1kon\u00edku pr\u00e1ce pracovn\u00ed pom\u011br <strong>okam\u017eit\u011b zru\u0161it<\/strong>.<br>Z\u00e1kladn\u00ed podm\u00ednkou je, \u017ee mzda (\u010di kter\u00e1koli jej\u00ed \u010d\u00e1st, nebo n\u00e1hrada mzdy) je alespo\u0148 15 dn\u00ed po splatnosti. Okam\u017eit\u00fdm zru\u0161en\u00edm dos\u00e1hne zam\u011bstnanec skon\u010den\u00ed pracovn\u00edho pom\u011bru ke dni doru\u010den\u00ed tohoto \u00fakonu zam\u011bstnavateli.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Splatnost mzdy vs. pravideln\u00fd term\u00edn v\u00fdplaty<\/h3>\n\n\n\n<p>Pozor, je t\u0159eba rozli\u0161ovat \u201esplatnost mzdy\u201c a \u201epravideln\u00fd term\u00edn v\u00fdplaty\u201c. Splatnost mzdy ze z\u00e1kona nast\u00e1v\u00e1 posledn\u00ed den m\u011bs\u00edce, kter\u00fd n\u00e1sleduje po m\u011bs\u00edci, ve kter\u00e9m vzniklo zam\u011bstnanci pr\u00e1vo na mzdu. <strong>P\u0159\u00edklad<\/strong>: mzda za m\u011bs\u00edc \u010derven se st\u00e1v\u00e1 splatnou 31. 7. V\u00fdjimkou m\u016f\u017ee b\u00fdt, je-li splatnost mzdy sjednan\u00e1 v\u00a0t\u0159eba pracovn\u00ed smlouv\u011b na d\u0159\u00edv\u011bj\u0161\u00ed datum, ale toto neb\u00fdv\u00e1 \u010dast\u00e9. V\u00a0pracovn\u00ed smlouv\u011b naopak \u010dasto b\u00fdv\u00e1 \u201epravideln\u00fd term\u00edn v\u00fdplaty\u201c; ten b\u00fdv\u00e1 stanoven na n\u011bkter\u00fd den v m\u011bs\u00edci n\u00e1sleduj\u00edc\u00edm po m\u011bs\u00edci, ve kter\u00e9m vzniklo zam\u011bstnanci pr\u00e1vo na mzdu (\u010dasto je to 15. nebo 20. den \u2013 v\u00a0na\u0161em p\u0159\u00edpad\u011b by to mohl b\u00fdt 15. 7., nebo t\u0159eba 20. 7.).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">P\u0159\u00edklad v\u00fdpo\u010dtu splatnosti mzdy<\/h3>\n\n\n\n<p>Okam\u017eit\u00e9 zru\u0161en\u00ed pracovn\u00edho pom\u011bru zam\u011bstnancem pro nevyplacen\u00ed mzdy lze podat po uplynut\u00ed 15 dn\u016f od term\u00ednu splatnosti ka\u017ed\u00e9 jednotliv\u00e9 platby. <strong>V\u00a0na\u0161em p\u0159\u00edpad\u011b tedy<\/strong>, pokud zam\u011bstnavatel nezaplatil zam\u011bstnanci mzdu za odpracovan\u00fd m\u011bs\u00edc \u010derven, splatnost mzdy nastala 31. 7., a zam\u011bstnanec m\u016f\u017ee zam\u011bstnavateli podat okam\u017eit\u00e9 zru\u0161en\u00ed pracovn\u00edho pom\u011bru dne 16. 8.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Jak\u00e9 n\u00e1roky m\u00e1 zam\u011bstnanec p\u0159i okam\u017eit\u00e9m zru\u0161en\u00ed pracovn\u00edho pom\u011bru?<\/h2>\n\n\n\n<p>Pokud jste v\u00a0situaci, kdy V\u00e1m zam\u011bstnavatel nezaplatil mzdu ani do 15 dn\u016f po splatnosti, pak m\u00e1te pr\u00e1vo na <strong>n\u00e1hradu mzdy ve v\u00fd\u0161i pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku za dobu v d\u00e9lce v\u00fdpov\u011bdn\u00ed doby<\/strong>. Jde o obdobu odstupn\u00e9ho. Odpov\u00edd\u00e1 v\u00fd\u0161i pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku za dobu v d\u00e9lce v\u00fdpov\u011bdn\u00ed doby. Pokud je Va\u0161e v\u00fdpov\u011bdn\u00ed doba 2 m\u011bs\u00edce (pozor, m\u016f\u017ee b\u00fdt i krat\u0161\u00ed), n\u00e1le\u017e\u00ed V\u00e1m p\u0159i okam\u017eit\u00e9m zru\u0161en\u00ed n\u00e1hrada mzdy ve v\u00fd\u0161i dvojn\u00e1sobku pr\u016fm\u011brn\u00e9ho m\u011bs\u00ed\u010dn\u00edho v\u00fdd\u011blku. Samoz\u0159ejm\u011b, vedle 2m\u011bs\u00ed\u010dn\u00ed n\u00e1hrady m\u016f\u017eete z\u00e1rove\u0148 n\u00e1rokovat dlu\u017enou mzdu za dosud odpracovanou dobu u zam\u011bstnavatele.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Nevyplacen\u00e1 mzda ve zku\u0161ebn\u00ed dob\u011b<\/h2>\n\n\n\n<p>Ve <strong>zku\u0161ebn\u00ed dob\u011b<\/strong> m\u016f\u017ee zam\u011bstnanec i zam\u011bstnavatel zru\u0161it pracovn\u00ed pom\u011br <strong>z\u00a0jak\u00e9hokoli d\u016fvodu i bez d\u016fvodu<\/strong>. Zam\u011bstnanci v\u00a0takov\u00e9m p\u0159\u00edpad\u011b nen\u00e1le\u017e\u00ed odstupn\u00e9 obecn\u011b ani \u017e\u00e1dn\u00e1 n\u00e1hrada mzdy.<\/p>\n\n\n\n<p>Ale m\u016f\u017ee doj\u00edt k n\u00e1sleduj\u00edc\u00ed\u00a0situaci: zam\u011bstnavatel z\u00a0n\u011bjak\u00e9ho d\u016fvodu nevyplat\u00ed mzdu zam\u011bstnanci ve zku\u0161ebn\u00ed dob\u011b. <strong>P\u0159\u00edklad<\/strong>: Pokud je mzda alespo\u0148 15 dn\u00ed po splatnosti (p\u0159\u00edpad v\u00fd\u0161e: nap\u0159. mzda za \u010derven zam\u011bstnanci nep\u0159i\u0161la ani do 15. 8.), zam\u011bstnanec m\u016f\u017ee <strong>okam\u017eit\u011b zru\u0161it pracovn\u00ed pom\u011br<\/strong> podle \u00a7 56 odst. 1 p\u00edsm. b) z\u00e1k. pr\u00e1ce. <strong>A v\u00a0tom p\u0159\u00edpad\u011b nen\u00ed podstatn\u00e9, zda je\u0161t\u011b trv\u00e1 zku\u0161ebn\u00ed doba, nebo ne<\/strong>.<\/p>\n\n\n\n<p>Zru\u0161en\u00ed pracovn\u00edho pom\u011bru ve zku\u0161ebn\u00ed dob\u011b (bez odstupn\u00e9ho \u010di n\u00e1hrady) a <strong>okam\u017eit\u00e9 zru\u0161en\u00ed pracovn\u00edho pom\u011bru zam\u011bstnancem<\/strong> (s n\u00e1hradou mzdy) \u2013 to jsou dva r\u016fzn\u00e9 zp\u016fsoby skon\u010den\u00ed pracovn\u00edho pom\u011bru. Pokud zam\u011bstnanec ve zku\u0161ebn\u00ed dob\u011b, jemu\u017e zam\u011bstnavatel dlu\u017e\u00ed mzdu, zvol\u00ed <strong>okam\u017eit\u00e9 zru\u0161en\u00ed<\/strong>, m\u016f\u017ee dos\u00e1hnout dvoum\u011bs\u00ed\u010dn\u00ed n\u00e1hrady mzdy nav\u00edc. \u00a0<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">\u010cast\u00e9 dotazy (FAQ) k nevyplacen\u00e9 mzd\u011b a okam\u017eit\u00e9mu zru\u0161en\u00ed pracovn\u00edho pom\u011bru<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Jak postupovat, kdy\u017e mi zam\u011bstnavatel nevyplat\u00ed mzdu?<\/h3>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>Nevyplacen\u00e1 mzda &#8211; ale za jak\u00e9 obdob\u00ed? Nejprve doporu\u010duji <strong>ov\u011b\u0159it splatnost mzdy<\/strong> \u2013 mzda je splatn\u00e1 nejpozd\u011bji do konce n\u00e1sleduj\u00edc\u00edho m\u011bs\u00edce (pravideln\u00fd term\u00edn v\u00fdplaty nen\u00ed pro splatnost mzdy ur\u010duj\u00edc\u00ed).<\/li>\n\n\n\n<li>Pokud mzda nep\u0159ijde, je vhodn\u00e9 zam\u011bstnavatele prvn\u011b <strong>p\u00edsemn\u011b vyzvat<\/strong> k zaplacen\u00ed.<\/li>\n\n\n\n<li>Jestli\u017ee mzda nen\u00ed vyplacena ani do <strong>15 dn\u016f po splatnosti<\/strong>, m\u00e1te pr\u00e1vo pracovn\u00ed pom\u011br <strong>okam\u017eit\u011b zru\u0161it<\/strong>.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Jak\u00fd je rozd\u00edl mezi v\u00fdpov\u011bd\u00ed a okam\u017eit\u00fdm zru\u0161en\u00edm pracovn\u00edho pom\u011bru?<\/h3>\n\n\n\n<p><strong>V\u00fdpov\u011b\u010f<\/strong>: po jej\u00edm pod\u00e1n\u00ed b\u011b\u017e\u00ed v\u00fdpov\u011bdn\u00ed doba (obvykle 2 m\u011bs\u00edce; za\u010d\u00edn\u00e1 dnem, v\u00a0n\u011bm\u017e byla v\u00fdpov\u011b\u010f doru\u010dena druh\u00e9 stran\u011b, a\u00a0kon\u010d\u00ed uplynut\u00edm 2 m\u011bs\u00edc\u016f). Zam\u011bstnanec b\u011bhem n\u00ed pracuje a pob\u00edr\u00e1 mzdu. D\u00e1-li v\u00fdpov\u011b\u010f zam\u011bstnanec, nen\u00e1le\u017e\u00ed mu odstupn\u00e9 ani \u017e\u00e1dn\u00e1 n\u00e1hrada.<\/p>\n\n\n\n<p><strong>Okam\u017eit\u00e9 zru\u0161en\u00ed<\/strong>: pracovn\u00ed pom\u011br kon\u010d\u00ed okam\u017eit\u011b. Zam\u011bstnanec u\u017e nechod\u00ed do pr\u00e1ce a m\u00e1 pr\u00e1vo na <strong>n\u00e1hradu mzdy<\/strong> za dobu odpov\u00eddaj\u00edc\u00ed d\u00e9lce v\u00fdpov\u011bdn\u00ed doby.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Plat\u00ed mo\u017enost okam\u017eit\u00e9ho zru\u0161en\u00ed pracovn\u00edho pom\u011bru i ve zku\u0161ebn\u00ed dob\u011b?<\/h3>\n\n\n\n<p>Ano. I b\u011bhem zku\u0161ebn\u00ed doby m\u00e1 zam\u011bstnanec pr\u00e1vo pracovn\u00ed pom\u011br okam\u017eit\u011b ukon\u010dit, pokud zam\u011bstnavatel <strong>nevyplat\u00ed mzdu ani do 15 dn\u016f po splatnosti<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Co kdy\u017e mi zam\u011bstnavatel vyplat\u00ed mzdu pozd\u011b, ale d\u0159\u00edve ne\u017e pod\u00e1m okam\u017eit\u00e9 zru\u0161en\u00ed pracovn\u00edho pom\u011bru?<\/h3>\n\n\n\n<p>Pokud je mzda sice vyplacena se zpo\u017ed\u011bn\u00edm, ale <strong>d\u0159\u00edv<\/strong>, ne\u017e zam\u011bstnanec pod\u00e1 okam\u017eit\u00e9 zru\u0161en\u00ed, pracovn\u00ed pom\u011br u\u017e nelze t\u00edmto zp\u016fsobem ukon\u010dit. V takov\u00e9m p\u0159\u00edpad\u011b z\u016fst\u00e1v\u00e1 mo\u017enost standardn\u00ed v\u00fdpov\u011bdi.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">M\u00e1m n\u00e1rok na odstupn\u00e9, kdy\u017e zru\u0161\u00edm pracovn\u00ed pom\u011br kv\u016fli nevyplacen\u00e9 mzd\u011b?<\/h3>\n\n\n\n<p>Ne, v tomto p\u0159\u00edpad\u011b nevznik\u00e1 n\u00e1rok na odstupn\u00e9. Zam\u011bstnanec m\u00e1 v\u0161ak n\u00e1rok na <strong>dlu\u017enou mzdu a n\u00e1hradu mzdy<\/strong> ve v\u00fd\u0161i pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku za dobu v d\u00e9lce v\u00fdpov\u011bdn\u00ed doby (n\u00e1hrada mzdy je obdobou odstupn\u00e9ho).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Jak\u00e9 jsou sankce pro zam\u011bstnavatele p\u0159i nevyplacen\u00ed mzdy?<\/h3>\n\n\n\n<p>Krom\u011b povinnosti doplatit dlu\u017enou mzdu a n\u00e1hradu mzdy, pop\u0159. i \u00faroky z\u00a0prodlen\u00ed, m\u016f\u017ee zam\u011bstnavateli hrozit i <strong>pokuta od inspekce pr\u00e1ce<\/strong> za nevyplacenou mzdu.
