Nebo sm\u011bnit \u010d\u00e1st sv\u00e9ho pozemku za \u010d\u00e1st sousedova pozemku? Nebo sv\u016fj pozemek rozd\u011blit mezi d\u011bti? Tyto situace se v praxi \u0159e\u0161\u00ed \u010dasto. Jak\u00fd je tedy postup d\u011blen\u00ed pozemku?<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-left\"><strong>Pozemek, nebo parcela?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-left\">Pozemek je \u010d\u00e1st\u00ed zemsk\u00e9ho povrchu odd\u011blenou ur\u010dit\u00fdm zp\u016fsobem od sousedn\u00edch \u010d\u00e1st\u00ed, zejm\u00e9na vlastnickou hranic\u00ed. Pozemky se v\u00a0katastru nemovitost\u00ed eviduj\u00ed jako <strong>parcely<\/strong>. <strong>Parcela<\/strong> je pozemek, kter\u00fd je geometricky a polohov\u011b ur\u010den\u00fd, zobrazen v katastr\u00e1ln\u00ed map\u011b a ozna\u010den parceln\u00edm \u010d\u00edslem. Pozemek se m\u016f\u017ee skl\u00e1dat z\u00a0v\u00edce parcel. Pokud tedy nakl\u00e1d\u00e1me s\u00a0pozemkem, budou d\u016fle\u017eit\u00e9 parcely \u2013 a jejich parceln\u00ed \u010d\u00edsla.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-left\"><strong>Jak na prodej\/darov\u00e1n\u00ed\/sm\u011bnu \u010d\u00e1sti pozemku?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-left\">Zkontrolujte v\u00a0katastru nemovitost\u00ed, zda se V\u00e1\u0161 pozemek skl\u00e1d\u00e1 z\u00a0jedn\u00e9 \u010di v\u00edce parcel. Pokud je parcel v\u00edce, lze s\u00a0nimi zpravidla nakl\u00e1dat bez d\u011blen\u00ed. Pokud jde o jednu parcelu, a Vy chcete p\u0159ev\u00e9st na n\u011bkoho jin\u00e9ho jen \u010d\u00e1st pozemku, pot\u0159ebujete nejd\u0159\u00edve pozemek rozd\u011blit.\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-left\">O rozd\u011blen\u00ed pozemku rozhoduje stavebn\u00ed \u00fa\u0159ad v&nbsp;\u00fazemn\u00edm \u0159\u00edzen\u00ed. Pro rozd\u011blen\u00ed pozemku mus\u00edte m\u00edt <strong>d\u016fvod<\/strong>, kter\u00fd bude stavebn\u00ed \u00fa\u0159ad posuzovat (zejm. zda je odd\u011blen\u00fd pozemek vymezen tak, aby velikost\u00ed, polohou, \u010di prostorov\u00fdm uspo\u0159\u00e1d\u00e1n\u00edm umo\u017e\u0148oval vyu\u017eit\u00ed pro dan\u00fd \u00fa\u010del, zda bude dopravn\u011b napojen na ve\u0159ejnou komunikaci). Stavebn\u00ed \u00fa\u0159ad v\u0161ak bude posuzovat i jin\u00e9 skute\u010dnosti.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-align-left\">D\u011blen\u00ed pozemku &#8211; <strong>jak za\u010d\u00edt?<\/strong><\/h3>\n\n\n\n<p class=\"has-text-align-left\">Pokud V\u00e1s nezastupuje <a href=\"https:\/\/hwlegal.cz\/en\/advokatni-kancelar-hw-legal\/\">zku\u0161en\u00fd advok\u00e1t<\/a>, nic nezkaz\u00edte t\u00edm, \u017ee se nejd\u0159\u00edv zastav\u00edte na stavebn\u00edm \u00fa\u0159ad\u011b a porad\u00edte se s\u00a0\u00fa\u0159edn\u00edky ohledn\u011b pl\u00e1novan\u00e9ho d\u011blen\u00ed pozemku. Mohou V\u00e1m dop\u0159edu nez\u00e1vazn\u011b posoudit, zda \u017e\u00e1dost o d\u011blen\u00ed \u201eprojde\u201c.<\/p>\n\n\n\n<h4 class=\"wp-block-heading has-text-align-left\"><strong>\u017d\u00e1dost o vyd\u00e1n\u00ed rozhodnut\u00ed o d\u011blen\u00ed pozemku<\/strong><\/h4>\n\n\n\n<p class=\"has-text-align-left\">Vypl\u0148te <strong>formul\u00e1\u0159 \u017e\u00e1dosti o vyd\u00e1n\u00ed rozhodnut\u00ed o d\u011blen\u00ed pozemku<\/strong>. Formul\u00e1\u0159 je dostupn\u00fd na webu Ministerstva pro m\u00edstn\u00ed rozvoj (<a href=\"https:\/\/www.mmr.cz\/cs\/ministerstvo\/stavebni-pravo\/pravo-a-legislativa\/stavebni-zakon\/novelizace-vyhlasky-c-503-2006-sb-(1)\">zde<\/a>).&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">V\u00a0\u017e\u00e1dosti pot\u0159ebujete popsat, jak bude pozemek rozd\u011blen\u00fd, jak\u00e9 budou v\u00fdm\u011bry nov\u00fdch pozemk\u016f a jak\u00e9 jsou d\u016fvody rozd\u011blen\u00ed.\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-left\">D\u00e1le pot\u0159ebujete p\u0159ilo\u017eit v\u0161echny p\u0159\u00edlohy, uveden\u00e9 v\u00a0\u010d\u00e1sti B. formul\u00e1\u0159e.\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-left\">Zejm\u00e9na je pot\u0159eba p\u0159ilo\u017eit n\u00e1vrh geometrick\u00e9ho pl\u00e1nu. V\u00a0t\u00e9to f\u00e1zi sta\u010d\u00ed, kdy\u017e vytisknete p\u0159\u00edslu\u0161nou \u010d\u00e1st katastr\u00e1ln\u00ed mapy, \u010derven\u011b ozna\u010d\u00edte pl\u00e1novan\u00e9 hranice, p\u0159ibli\u017en\u011b nov\u00e9 pozemky ok\u00f3tujete, ozna\u010d\u00edte je p\u00edsmeny, a vyzna\u010d\u00edte p\u0159\u00edstupy z\u00a0nov\u00fdch pozemk\u016f na\u00a0ve\u0159ejn\u00e9 komunikace.\u00a0\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-left\">D\u00e1le je t\u0159eba dodat z\u00e1vazn\u00e1 stanoviska dot\u010den\u00fdch org\u00e1n\u016f (p\u0159. <a href=\"https:\/\/nature.cz\/chci-ziskat-stanovisko-pro-jiny-spravni-organ\">org\u00e1n ochrany p\u0159\u00edrody a krajiny<\/a>).&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">Pokud pozemek vlastn\u00ed v\u00edce spoluvlastn\u00edk\u016f, mus\u00ed v\u0161ichni s&nbsp;rozd\u011blen\u00edm ud\u011blit souhlas.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">\u017d\u00e1dost v\u010detn\u011b p\u0159\u00edloh se pod\u00e1v\u00e1 na <a href=\"https:\/\/www.zakonyprolidi.cz\/cs\/2021-283\">p\u0159\u00edslu\u0161n\u00e9m stavebn\u00edm \u00fa\u0159ad\u011b<\/a>.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading has-text-align-left\"><strong>Rozhodnut\u00ed stavebn\u00edho \u00fa\u0159adu \u2013 jak dlouho trv\u00e1? A jak\u00fd je spr\u00e1vn\u00ed poplatek?<\/strong><\/h4>\n\n\n\n<p class=\"has-text-align-left\">V&nbsp;jednoduch\u00fdch p\u0159\u00edpadech stavebn\u00ed \u00fa\u0159ad rozhoduje ve lh\u016ft\u011b do 60 dn\u00ed, ve zvl\u00e1\u0161\u0165 slo\u017eit\u00fdch p\u0159\u00edpadech nejd\u00e9le ve lh\u016ft\u011b do 90 dn\u016f. Spr\u00e1vn\u00ed poplatek je 1.000,- K\u010d.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">Stavebn\u00ed \u00fa\u0159ad \u017e\u00e1dost schv\u00e1l\u00ed bez dal\u0161\u00edho, nebo schv\u00e1l\u00ed a vymez\u00ed podm\u00ednky pro rozd\u011blen\u00ed pozemk\u016f a ur\u010den\u00ed nov\u00fdch hranic, p\u0159\u00edpadn\u011b zam\u00edtne, pokud by nap\u0159. rozd\u011blen\u00edm byly ohro\u017eeny z\u00e1jmy vlastn\u00edk\u016f okoln\u00edch pozemk\u016f \u010di ve\u0159ejn\u00fd z\u00e1jem.<\/p>\n\n\n\n<p class=\"has-text-align-left\">U n\u011bkter\u00fdch druh\u016f pozemk\u016f d\u011blen\u00ed podl\u00e9h\u00e1 speci\u00e1ln\u00edm podm\u00ednk\u00e1m. Nap\u0159. pokud by u lesn\u00edho pozemku m\u011bla rozd\u011blen\u00edm klesnout v\u00fdm\u011bra pod 1 ha, je k&nbsp;rozd\u011blen\u00ed t\u0159eba souhlasu org\u00e1nu st\u00e1tn\u00ed spr\u00e1vy les\u016f. Ten souhlas nevyd\u00e1, pokud by tvar nebo velikost nov\u00e9ho pozemku neumo\u017e\u0148oval \u0159\u00e1dn\u00e9 hospoda\u0159en\u00ed v lese.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-left\">V&nbsp;rozhodnut\u00ed stavebn\u00edho \u00fa\u0159adu jsou d\u016fle\u017eit\u00e9 \u00fadaje: zejm. parceln\u00ed \u010d\u00edsla, ur\u010den\u00ed hranic nov\u00fdch pozemk\u016f, p\u0159\u00edstup k&nbsp;ve\u0159ejn\u00e9 komunikaci ke ka\u017ed\u00e9mu pozemku, a v\u0161e je t\u00e9\u017e zakresleno na map\u011b v&nbsp;grafick\u00e9 p\u0159\u00edloze.<\/p>","protected":false},"excerpt":{"rendered":"<p>Cht\u011bli byste prodat \u010d\u00e1st sv\u00e9ho pozemku?
