{"id":804,"date":"2024-08-01T07:54:06","date_gmt":"2024-08-01T07:54:06","guid":{"rendered":"https:\/\/hwlegal.cz\/?p=804"},"modified":"2024-08-01T08:21:34","modified_gmt":"2024-08-01T08:21:34","slug":"pozemkove-upravy","status":"publish","type":"post","link":"https:\/\/hwlegal.cz\/en\/pozemkove-upravy\/","title":{"rendered":"Land Improvements - What Can I Do As an Owner?"},"content":{"rendered":"\n<p>Pozemkov\u00e9 \u00fapravy jsou zp\u016fsobem omezen\u00ed vlastnick\u00e9ho pr\u00e1va k pozemku.<\/p>\n\n\n\n\n\n\n\n\n\n<p>Jde o&nbsp;<em>de facto<\/em>&nbsp;vyvlastn\u011bn\u00ed,<a href=\"https:\/\/www.pravniprostor.cz\/clanky\/spravni-pravo\/pozemkove-upravy-co-mohu-jako-vlastnik-delat#note-1\">[1]<\/a>&nbsp;kter\u00e9 prob\u00edh\u00e1 1) na z\u00e1klad\u011b z\u00e1kona, 2) ve ve\u0159ejn\u00e9m z\u00e1jmu a 3) za n\u00e1hradu. Za t\u011bchto podm\u00ednek vyhovuj\u00ed pozemkov\u00e9 \u00fapravy p\u0159edpoklad\u016fm pro vyvlastn\u011bn\u00ed dle Listiny z\u00e1kladn\u00edch pr\u00e1v a svobod (<a href=\"https:\/\/next.codexis.cz\/legislativa\/CR958_2021_10_01?shareToken=3b45c1fe7c8e4bc6ecc3cf3c#unit-70\" target=\"_blank\" rel=\"noreferrer noopener\">\u010dl. 11 odst. 4<\/a>).&nbsp;<\/p>\n\n\n\n<p>Pozemkov\u00e9 \u00fapravy jsou cestou, jak&nbsp;<strong>zm\u011bnit uspo\u0159\u00e1d\u00e1n\u00ed pozemk\u016f<\/strong>&nbsp;v ur\u010dit\u00e9 p\u0159edem ur\u010den\u00e9 oblasti. C\u00edlem je vytvo\u0159en\u00ed p\u016fdn\u011b ucelen\u00fdch hospod\u00e1\u0159sk\u00fdch jednotek. Ve ve\u0159ejn\u00e9m z\u00e1jmu se prostorov\u011b a funk\u010dn\u011b uspo\u0159\u00e1d\u00e1vaj\u00ed pozemky, sceluj\u00ed se nebo d\u011bl\u00ed; zanikaj\u00ed p\u016fvodn\u00ed pozemky a vytv\u00e1\u0159en\u00ed se nov\u00e9, kter\u00e9 se rozd\u011bluj\u00ed mezi p\u016fvodn\u00ed vlastn\u00edky.&nbsp;<\/p>\n\n\n\n<p>Pozemkov\u00fdmi \u00fapravami se zabezpe\u010duje p\u0159\u00edstupnost a vyu\u017eit\u00ed pozemk\u016f, vyrovn\u00e1vaj\u00ed se jejich hranice tak, aby se vytvo\u0159ily podm\u00ednky pro racion\u00e1ln\u00ed hospoda\u0159en\u00ed vlastn\u00edk\u016f p\u016fdy. Pozemkov\u00e9 \u00fapravy maj\u00ed v\u00e9st ke zlep\u0161en\u00ed kvality \u017eivota ve venkovsk\u00fdch oblastech v\u010detn\u011b napom\u00e1h\u00e1n\u00ed diverzifikace hospod\u00e1\u0159sk\u00e9 \u010dinnosti a zlep\u0161ov\u00e1n\u00ed konkurenceschopnosti zem\u011bd\u011blstv\u00ed, zlep\u0161en\u00ed \u017eivotn\u00edho prost\u0159ed\u00ed, ochrany a z\u00farodn\u011bn\u00ed p\u016fdn\u00edho fondu, lesn\u00edho hospod\u00e1\u0159stv\u00ed a vodn\u00edho hospod\u00e1\u0159stv\u00ed, zejm\u00e9na v oblasti sni\u017eov\u00e1n\u00ed nep\u0159\u00edzniv\u00fdch \u00fa\u010dink\u016f povodn\u00ed a sucha, \u0159e\u0161en\u00ed odtokov\u00fdch pom\u011br\u016f v krajin\u011b a zv\u00fd\u0161en\u00ed ekologick\u00e9 stability krajiny.<a href=\"https:\/\/www.pravniprostor.cz\/clanky\/spravni-pravo\/pozemkove-upravy-co-mohu-jako-vlastnik-delat#note-2\">[2]<\/a>&nbsp;<\/p>\n\n\n\n<p>V praxi b\u00fdvaj\u00ed d\u016fvodem zam\u00fd\u0161len\u00e9 stavebn\u00ed projekty, budov\u00e1n\u00ed infrastruktury. Doch\u00e1z\u00ed ke sn\u00ed\u017een\u00ed po\u010dtu parcel \u2013 vlastn\u00edk\u016fm mnoha mal\u00fdch parcel \u201erozdroben\u00fdch\u201c v oblasti se jejich pozemky (\u010d\u00e1ste\u010dn\u011b) vym\u011bn\u00ed za jin\u00e9, \u010dasto v\u011bt\u0161\u00ed a rozumn\u011bji rozprost\u0159en\u00e9 celky. Sni\u017eov\u00e1n\u00ed po\u010dtu parcel v\u0161ak samo o sob\u011b nen\u00ed v z\u00e1kon\u011b ozna\u010deno za c\u00edl pozemkov\u00fdch \u00faprav.<\/p>\n\n\n\n\n\n\n<div class=\"text-content-inner\">\n<p>\u0158\u00edzen\u00ed o pozemkov\u00fdch \u00faprav\u00e1ch zahajuje v\u017edy pozemkov\u00fd \u00fa\u0159ad, a to dle vlastn\u00edho posouzen\u00ed nebo na z\u00e1klad\u011b po\u017eadavku ze strany kohokoli. \u0158\u00edzen\u00ed se m\u00e1 za zah\u00e1jen\u00e9 v\u017edy z podn\u011btu pozemkov\u00e9ho \u00fa\u0159adu. \u0158\u00edzen\u00ed v\u0161ak zah\u00e1j\u00ed v\u017edy, podpo\u0159\u00ed-li to vlastn\u00edci v\u00edce ne\u017e poloviny v\u00fdm\u011bry zem\u011bd\u011blsk\u00e9 p\u016fdy v dot\u010den\u00e9m katastr\u00e1ln\u00edm \u00fazem\u00ed. Zah\u00e1jen\u00ed \u0159\u00edzen\u00ed ozn\u00e1m\u00ed pozemkov\u00fd \u00fa\u0159ad ve\u0159ejnou vyhl\u00e1\u0161kou.<\/p>\n\n<p>Pozemkov\u00e9 \u00fapravy lze prov\u00e1d\u011bt v tzv.&nbsp;<strong>obvodu pozemkov\u00fdch \u00faprav<\/strong>. To je \u00fazem\u00ed stanoven\u00e9 pozemkov\u00fdm \u00fa\u0159adem. U n\u011bkter\u00fdch pozemk\u016f je t\u0159eba aby jejich vlastn\u00edk dal&nbsp;<strong>souhlas<\/strong>&nbsp;k jejich zahrnut\u00ed do pozemkov\u00fdch \u00faprav, a to p\u0159edev\u0161\u00edm u:&nbsp;<\/p>\n\n<ul class=\"wp-block-list\">\n<li>pozemk\u016f zastav\u011bn\u00fdch stavbou v soukrom\u00e9m vlastnictv\u00ed a pozemk\u016f funk\u010dn\u011b souvisej\u00edc\u00edch s touto stavbou v\u010detn\u011b p\u0159\u00edstupov\u00e9 cesty,&nbsp;<\/li>\n\n\n\n<li>zahrad,<\/li>\n\n\n\n<li>pozemk\u016f v zastav\u011bn\u00e9m \u00fazem\u00ed,&nbsp;<\/li>\n\n\n\n<li>pozemk\u016f v zastaviteln\u00fdch ploch\u00e1ch.<\/li>\n<\/ul>\n\n<p>Pozemkov\u00fd \u00fa\u0159ad za\u0161le vlastn\u00edk\u016fm takov\u00fdch pozemk\u016f na po\u010d\u00e1tku \u0159\u00edzen\u00ed o pozemkov\u00fdch \u00faprav\u00e1ch&nbsp;<strong>v\u00fdzvu k&nbsp;vyj\u00e1d\u0159en\u00ed<\/strong>.<a href=\"https:\/\/www.pravniprostor.cz\/clanky\/spravni-pravo\/pozemkove-upravy-co-mohu-jako-vlastnik-delat#note-3\">[3]<\/a>&nbsp;Tato v\u00fdzva je velmi&nbsp;<strong>d\u016fle\u017eit\u00e1<\/strong>: pokud se toti\u017e vlastn\u00edci ve lh\u016ft\u011b stanoven\u00e9 pozemkov\u00fdm \u00fa\u0159adem ve lh\u016ft\u011b nevyj\u00e1d\u0159\u00ed, m\u00e1 se za to, \u017ee s jejich \u0159e\u0161en\u00edm v pozemkov\u00fdch \u00faprav\u00e1ch&nbsp;<strong>souhlas\u00ed<\/strong>. Je proto t\u0159eba na v\u00fdzvu v\u010das reagovat.<\/p>\n\n<h3 class=\"wp-block-heading has-heading-3-font-size\">Kdo jsou \u00fa\u010dastn\u00edci \u0159\u00edzen\u00ed o pozemkov\u00fdch \u00faprav\u00e1ch?<\/h3>\n\n<p>\u00da\u010dastn\u00edky \u0159\u00edzen\u00ed jsou:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>vlastn\u00edci dot\u010den\u00fdch pozemk\u016f a osoby, jejich\u017e vlastnick\u00e1 nebo jin\u00e1 pr\u00e1va k pozemk\u016fm mohou b\u00fdt \u0159e\u0161en\u00edm pozemkov\u00fdch \u00faprav p\u0159\u00edmo dot\u010dena,<\/li>\n\n\n\n<li>stavebn\u00edk, jestli\u017ee je proveden\u00ed pozemkov\u00fdch \u00faprav vyvol\u00e1no v d\u016fsledku stavebn\u00ed \u010dinnosti,<\/li>\n\n\n\n<li>obce, v jejich\u017e \u00fazemn\u00edm obvodu jsou pozemky zahrnut\u00e9 do pozemkov\u00fdch \u00faprav a za ur\u010dit\u00fdch podm\u00ednek i obce, jejich\u017e \u00fazemn\u00ed obvod soused\u00ed s pozemky zahrnut\u00fdmi do pozemkov\u00fdch \u00faprav.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading has-heading-2-font-size\">Pr\u016fb\u011bh pozemkov\u00fdch \u00faprav<\/h2>\n\n<h3 class=\"wp-block-heading has-heading-3-font-size\">1) Zah\u00e1jen\u00ed pozemkov\u00fdch \u00faprav<\/h3>\n\n<p>Zah\u00e1jen\u00ed pozemkov\u00e9 \u00fapravy pozemkov\u00fd \u00fa\u0159ad vyhl\u00e1s\u00ed&nbsp;<strong>ve\u0159ejnou vyhl\u00e1\u0161kou<\/strong>, kter\u00e1 se vyv\u011bs\u00ed po dobu 15 dn\u016f na \u00fa\u0159edn\u00ed desce pozemkov\u00e9ho \u00fa\u0159adu a obc\u00ed, v jejich\u017e \u00fazemn\u00edch obvodech jsou pozemky zahrnut\u00e9 do pozemkov\u00fdch \u00faprav. Po\u0161tou se toto ozn\u00e1men\u00ed nedoru\u010duje. Je tedy vhodn\u00e9 pravideln\u011b sledovat \u00fa\u0159edn\u00ed desku.<\/p>\n\n<h3 class=\"wp-block-heading has-heading-3-font-size\">2) \u00davodn\u00ed jedn\u00e1n\u00ed<\/h3>\n\n<p>Pozemkov\u00fd \u00fa\u0159ad pozve na \u00favodn\u00ed jedn\u00e1n\u00ed v\u0161echny \u00fa\u010dastn\u00edky a dal\u0161\u00ed vlastn\u00edky pozemk\u016f v p\u0159edpokl\u00e1dan\u00e9m obvodu pozemkov\u00fdch \u00faprav. Zde je sezn\u00e1m\u00ed s \u00fa\u010delem, formou a p\u0159edpokl\u00e1dan\u00fdm obvodem pozemkov\u00fdch \u00faprav.&nbsp;<\/p>\n\n<h3 class=\"wp-block-heading has-heading-3-font-size\">3) Soupis a ocen\u011bn\u00ed n\u00e1rok\u016f vlastn\u00edk\u016f<\/h3>\n\n<p>Pozemkov\u00fd \u00fa\u0159ad zabezpe\u010d\u00ed vypracov\u00e1n\u00ed soupisu n\u00e1rok\u016f vlastn\u00edk\u016f pozemk\u016f. V soupisu se u pozemk\u016f uvede jejich cena, v\u00fdm\u011bra, vzd\u00e1lenost, druh a omezen\u00ed (z\u00e1stavn\u00ed pr\u00e1va, p\u0159edkupn\u00ed pr\u00e1va a v\u011bcn\u00e1 b\u0159emena).<\/p>\n\n<p>\u010casto doch\u00e1z\u00ed k nedorozum\u011bn\u00ed ohledn\u011b zp\u016fsobu&nbsp;<strong>ocen\u011bn\u00ed pozemk\u016f<\/strong>. P\u0159i pozemkov\u00fdch \u00faprav\u00e1ch se toti\u017e nevych\u00e1z\u00ed z&nbsp;tr\u017en\u00ed ceny pozemk\u016f (tedy ceny, kterou vlastn\u00edci v\u00eddaj\u00ed nap\u0159. v&nbsp;nab\u00eddce realitn\u00edch kancel\u00e1\u0159\u00ed), ale ze zvl\u00e1\u0161tn\u00edch p\u0159edpis\u016f (z\u00e1kon o oce\u0148ov\u00e1n\u00ed majetku, oce\u0148ovac\u00ed vyhl\u00e1\u0161ka)<a href=\"https:\/\/www.pravniprostor.cz\/clanky\/spravni-pravo\/pozemkove-upravy-co-mohu-jako-vlastnik-delat#note-4\">[4]<\/a>.<\/p>\n\n<p>Hotov\u00fd&nbsp;<strong>soupis<\/strong>&nbsp;vylo\u017e\u00ed pozemkov\u00fd \u00fa\u0159ad po dobu 15 dn\u016f na obecn\u00edm \u00fa\u0159ad\u011b a z\u00e1rove\u0148 jej doru\u010d\u00ed vlastn\u00edk\u016fm, jejich\u017e pobyt je mu zn\u00e1m. K tomuto soupisu n\u00e1rok\u016f mohou vlastn\u00edci&nbsp;<strong>uplatnit n\u00e1mitky<\/strong>&nbsp;ve lh\u016ft\u011b ur\u010den\u00e9 pozemkov\u00fdm \u00fa\u0159adem. N\u00e1mitky pozemkov\u00fd \u00fa\u0159ad projedn\u00e1. Vlastn\u00edci mus\u00ed b\u00fdt o vy\u0159\u00edzen\u00ed n\u00e1mitek p\u00edsemn\u011b vyrozum\u011bni.<\/p>\n\n<h3 class=\"wp-block-heading has-heading-3-font-size\">4) N\u00e1vrh pozemkov\u00fdch \u00faprav<\/h3>\n\n<p>Pozemkov\u00fd \u00fa\u0159ad zajist\u00ed odborn\u00e9 zpracov\u00e1n\u00ed n\u00e1vrhu pozemkov\u00fdch \u00faprav. Podkladem pro n\u011bj je v\u00fdsledek zem\u011bm\u011b\u0159i\u010dsk\u00e9 \u010dinnosti \u2013 zji\u0161\u0165uje se pr\u016fb\u011bh hranic pozemk\u016f, prov\u00e1d\u00ed se zam\u011b\u0159en\u00ed skute\u010dn\u00e9ho stavu v ter\u00e9nu, up\u0159es\u0148uje se obvod pozemkov\u00fdch \u00faprav a okruh \u00fa\u010dastn\u00edk\u016f.&nbsp;<\/p>\n\n<p>Z\u00e1kladem pro n\u00e1vrh pozemkov\u00fdch \u00faprav je pl\u00e1n spole\u010dn\u00fdch za\u0159\u00edzen\u00ed (cesty, vodohospod\u00e1\u0159sk\u00e1 opat\u0159en\u00ed, meze, v\u011btrolamy, opat\u0159en\u00ed k ochran\u011b \u017eivotn\u00edho prost\u0159ed\u00ed \u2013 p\u0159. doprovodn\u00e1 zele\u0148). Pl\u00e1n spole\u010dn\u00fdch za\u0159\u00edzen\u00ed mus\u00ed schv\u00e1lit zastupitelstvo obce. Pl\u00e1n spole\u010dn\u00fdch za\u0159\u00edzen\u00ed se povinn\u011b zpracov\u00e1v\u00e1 u komplexn\u00edch pozemkov\u00fdch \u00faprav (co\u017e je b\u011b\u017en\u00e1 forma pozemkov\u00fdch \u00faprav). V&nbsp;p\u0159\u00edpad\u011b jednoduch\u00fdch pozemkov\u00fdch \u00faprav ho nen\u00ed t\u0159eba. Okolo t\u011bchto spole\u010dn\u00fdch za\u0159\u00edzen\u00ed se skl\u00e1daj\u00ed a uspo\u0159\u00e1d\u00e1vaj\u00ed nov\u00e9 pozemky. Oproti p\u016fvodn\u00edmu rozlo\u017een\u00ed vedou hranice jinak \u2013 tak, aby vznikaly v\u011bt\u0161\u00ed celky, pop\u0159. aby hranice pozemk\u016f vyhovovaly ter\u00e9nn\u00edm \u00fatvar\u016fm. Vznikne n\u00e1vrh pozemkov\u00fdch \u00faprav.<a href=\"https:\/\/www.pravniprostor.cz\/clanky\/spravni-pravo\/pozemkove-upravy-co-mohu-jako-vlastnik-delat#note-5\">[5]<\/a>&nbsp;<\/p>\n\n<p>Rozd\u011blen\u00ed nov\u00fdch pozemk\u016f mezi vlastn\u00edky mus\u00ed respektovat z\u00e1konn\u00e1 krit\u00e9ria p\u0159im\u011b\u0159enosti. Posuzuje se stav p\u0159ed zah\u00e1jen\u00edm pozemkov\u00fdch \u00faprav a stav dle n\u00e1vrhu pozemkov\u00fdch \u00faprav:&nbsp;<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Cena je p\u0159im\u011b\u0159en\u00e1, jestli\u017ee nen\u00ed v porovn\u00e1n\u00ed s p\u016fvodn\u00ed cenou ni\u017e\u0161\u00ed nebo vy\u0161\u0161\u00ed o v\u00edce ne\u017e 4 %.<\/li>\n\n\n\n<li>V\u00fdm\u011bra je p\u0159im\u011b\u0159en\u00e1, pokud rozd\u00edl v\u00fdm\u011bry p\u016fvodn\u00edch a navrhovan\u00fdch pozemk\u016f nep\u0159esahuje 10 % v\u00fdm\u011bry p\u016fvodn\u00edch pozemk\u016f.<\/li>\n\n\n\n<li>Vzd\u00e1lenost je p\u0159im\u011b\u0159en\u00e1, pokud rozd\u00edl ve vzd\u00e1lenosti p\u016fvodn\u00edch a navrhovan\u00fdch pozemk\u016f nen\u00ed vy\u0161\u0161\u00ed nebo ni\u017e\u0161\u00ed ne\u017e 20 %.<\/li>\n<\/ul>\n\n<p>Tato krit\u00e9ria by m\u011bla b\u00fdt dodr\u017eena.&nbsp;<strong>P\u0159ekro\u010dit<\/strong>&nbsp;krit\u00e9rium ceny je ve prosp\u011bch vlastn\u00edka lze jen s jeho souhlasem \u2013 vznikne mu tak toti\u017e povinnost uhradit rozd\u00edl v cen\u011b pozemk\u016f. Ve v\u00fdjime\u010dn\u00fdch p\u0159\u00edpadech lze upustit od povinnosti uhradit rozd\u00edl v cen\u011b (zejm. pokud vlastn\u00edk vstoupil do \u0159\u00edzen\u00ed jen s jedn\u00edm pozemkem, nebo jeho pozemek ne\u0161lo z technick\u00fdch d\u016fvod\u016f um\u00edstit tak, aby krit\u00e9rium ceny nebylo p\u0159ekro\u010deno).<\/p>\n\n<p>Po zpracov\u00e1n\u00ed n\u00e1vrhu pozemkov\u00fdch \u00faprav pozemkov\u00fd \u00fa\u0159ad ozn\u00e1m\u00ed na sv\u00e9 \u00fa\u0159edn\u00ed desce a na \u00fa\u0159edn\u00edch desk\u00e1ch dot\u010den\u00fdch obc\u00ed, kde je mo\u017eno po dobu 30 dn\u016f nahl\u00e9dnout do zpracovan\u00e9ho n\u00e1vrhu. O vystaven\u00ed n\u00e1vrhu vyrozum\u00ed zn\u00e1m\u00e9 \u00fa\u010dastn\u00edky a sd\u011bl\u00ed jim, \u017ee v t\u00e9to 30denn\u00ed lh\u016ft\u011b maj\u00ed&nbsp;<strong>posledn\u00ed mo\u017enost uplatnit k n\u00e1vrhu n\u00e1mitky a p\u0159ipom\u00ednky<\/strong>&nbsp;u pozemkov\u00e9ho \u00fa\u0159adu. Na z\u00e1klad\u011b t\u011bchto n\u00e1mitek a p\u0159ipom\u00ednek m\u016f\u017ee pozemkov\u00fd \u00fa\u0159ad n\u00e1vrh upravit.&nbsp;<\/p>\n\n<h3 class=\"wp-block-heading has-heading-3-font-size\">5) Rozhodnut\u00ed o pozemkov\u00fdch \u00faprav\u00e1ch<\/h3>\n\n<p>N\u00e1sledn\u011b svol\u00e1 pozemkov\u00fd \u00fa\u0159ad&nbsp;<strong>z\u00e1v\u011bre\u010dn\u00e9 jedn\u00e1n\u00ed<\/strong>, na kter\u00e9m zhodnot\u00ed v\u00fdsledky pozemkov\u00fdch \u00faprav a sezn\u00e1m\u00ed \u00fa\u010dastn\u00edky s n\u00e1vrhem, o n\u011bm\u017e se bude rozhodovat.&nbsp;<\/p>\n\n<p>Nov\u00e9 uspo\u0159\u00e1d\u00e1n\u00ed pozemk\u016f schvaluj\u00ed vlastn\u00edci dot\u010den\u00fdch pozemk\u016f podpisem soupisu nov\u00fdch pozemk\u016f.&nbsp;<strong>Pozor<\/strong>: podpis tohoto dokumentu m\u00e1 z\u00e1va\u017en\u00e9 d\u016fsledky. Podle judikatury toti\u017e plat\u00ed, \u017ee ud\u011bl\u00ed-li vlastn\u00edk pozemku na soupisu nov\u00fdch pozemk\u016f souhlas s nov\u00fdm uspo\u0159\u00e1d\u00e1n\u00edm pozemk\u016f, nem\u016f\u017ee b\u00fdt rozhodnut\u00edm o schv\u00e1len\u00ed n\u00e1vrhu komplexn\u00edch pozemkov\u00fdch \u00faprav zkr\u00e1cen na sv\u00fdch hmotn\u00fdch pr\u00e1vech.<a href=\"https:\/\/www.pravniprostor.cz\/clanky\/spravni-pravo\/pozemkove-upravy-co-mohu-jako-vlastnik-delat#note-6\">[6]<\/a>&nbsp;To znamen\u00e1, \u017ee podpisem soupisu nov\u00fdch pozemk\u016f vlastn\u00edk stvrzuje, \u017ee nov\u00e9 uspo\u0159\u00e1d\u00e1n\u00ed pozemk\u016f je (ve vztahu k n\u011bmu) spr\u00e1vn\u00e9, a toto nov\u00e9 uspo\u0159\u00e1d\u00e1n\u00ed p\u0159ij\u00edm\u00e1.<\/p>\n\n<p><strong>Praktick\u00e9 upozorn\u011bn\u00ed<\/strong>: Souhlas dan\u00fd v&nbsp;\u0159\u00edzen\u00ed o pozemkov\u00fdch \u00faprav\u00e1ch nelze vz\u00edt zp\u011bt, ani\u017e by se zp\u011btvzet\u00edm pozemkov\u00fd \u00fa\u0159ad vyj\u00e1d\u0159il souhlas.<\/p>\n\n<p>Pozemkov\u00fd \u00fa\u0159ad rozhodne o schv\u00e1len\u00ed n\u00e1vrhu pozemkov\u00fdch \u00faprav, pokud s n\u00edm souhlas\u00ed vlastn\u00edci alespo\u0148 60 % v\u00fdm\u011bry pozemk\u016f, kter\u00e9 jsou v pozemkov\u00fdch \u00faprav\u00e1ch \u0159e\u0161eny.&nbsp;<strong>Pozor<\/strong>: ne\u010dinnost zde neznamen\u00e1 nesouhlas. V p\u0159\u00edpad\u011b, kdy se vlastn\u00edk pozemku k nov\u00e9mu uspo\u0159\u00e1d\u00e1n\u00ed pozemk\u016f nevyj\u00e1d\u0159\u00ed, vyzve jej pozemkov\u00fd \u00fa\u0159ad, aby tak u\u010dinil ve lh\u016ft\u011b 15 dn\u016f. Pokud se vlastn\u00edk nevyj\u00e1d\u0159\u00ed ani v t\u00e9to lh\u016ft\u011b, m\u00e1 se za to, \u017ee s nov\u00fdm uspo\u0159\u00e1d\u00e1n\u00edm pozemk\u016f souhlas\u00ed.<\/p>\n\n<p>Rozhodnut\u00ed o schv\u00e1len\u00ed n\u00e1vrhu pozemkov\u00fd \u00fa\u0159ad ozn\u00e1m\u00ed doru\u010den\u00edm ve\u0159ejnou vyhl\u00e1\u0161kou a&nbsp;<strong>doru\u010d\u00ed<\/strong>&nbsp;v\u0161em zn\u00e1m\u00fdm \u00fa\u010dastn\u00edk\u016fm. \u00da\u010dastn\u00edk\u016fm se v\u0161ak doru\u010duje jen ta p\u00edsemn\u00e1 a grafick\u00e1 \u010d\u00e1st n\u00e1vrhu, kter\u00e1 se jich konkr\u00e9tn\u011b t\u00fdk\u00e1.&nbsp;<\/p>\n\n<p>Na rozhodnut\u00ed o schv\u00e1len\u00ed n\u00e1vrhu navazuj\u00ed dal\u0161\u00ed rozhodnut\u00ed: o v\u00fdm\u011bn\u011b \/ p\u0159echodu vlastnick\u00fdch pr\u00e1v, o z\u0159\u00edzen\u00ed \/ zru\u0161en\u00ed v\u011bcn\u00e9ho b\u0159emene vydan\u00e9ho na z\u00e1klad\u011b schv\u00e1len\u00e9ho n\u00e1vrhu.&nbsp;<strong>Pozor<\/strong>: proti t\u011bmto navazuj\u00edc\u00edm rozhodnut\u00edm se nelze zvl\u00e1\u0161\u0165 odvolat: odvol\u00e1n\u00ed je t\u0159eba podat proti rozhodnut\u00ed o schv\u00e1len\u00ed n\u00e1vrhu pozemkov\u00fdch \u00faprav.&nbsp;<\/p>\n\n<p>Rozhodnut\u00ed o schv\u00e1len\u00ed n\u00e1vrhu, kter\u00e9 nabylo pr\u00e1vn\u00ed moci (tzn. v\u016f\u010di kter\u00e9mu se ji\u017e nelze odvolat), pozemkov\u00fd \u00fa\u0159ad p\u0159ed\u00e1 katastr\u00e1ln\u00edmu \u00fa\u0159adu k vyzna\u010den\u00ed do katastru nemovitost\u00ed.<\/p>\n\n<h2 class=\"wp-block-heading has-heading-2-font-size\">Obrana proti schv\u00e1len\u00e9mu n\u00e1vrhu pozemkov\u00fdch \u00faprav<\/h2>\n\n<p>Proti rozhodnut\u00ed o pozemkov\u00fdch \u00faprav\u00e1ch se lze&nbsp;<strong>odvolat<\/strong>, a to ve lh\u016ft\u011b 15 dn\u016f od ozn\u00e1men\u00ed (doru\u010den\u00ed) rozhodnut\u00ed. Odvol\u00e1n\u00ed se adresuje pozemkov\u00e9mu \u00fa\u0159adu, kter\u00fd rozhodnut\u00ed vydal, a rozhoduje o n\u011bm St\u00e1tn\u00ed pozemkov\u00fd \u00fa\u0159ad (coby nad\u0159\u00edzen\u00fd spr\u00e1vn\u00ed org\u00e1n). K&nbsp;odvol\u00e1n\u00ed se vyjad\u0159uje jak pozemkov\u00fd \u00fa\u0159ad, tak se k&nbsp;n\u011bmu mohou vyj\u00e1d\u0159it i \u00fa\u010dastn\u00edci \u0159\u00edzen\u00ed o pozemkov\u00fdch \u00faprav\u00e1ch.<\/p>\n\n<p>St\u00e1tn\u00ed pozemkov\u00fd \u00fa\u0159ad m\u016f\u017ee rozhodnut\u00ed o schv\u00e1len\u00ed n\u00e1vrhu pozemkov\u00fdch \u00faprav&nbsp;<strong>zm\u011bnit<\/strong>&nbsp;nebo&nbsp;<strong>zru\u0161it<\/strong>&nbsp;\u2013 takov\u00e9 rozhodnut\u00ed odvolatel\u00e9 obvykle navrhuj\u00ed. V p\u0159\u00edpad\u011b, \u017ee by St\u00e1tn\u00ed pozemkov\u00fd \u00fa\u0159ad odvol\u00e1n\u00ed zam\u00edtl a rozhodnut\u00ed potvrdil, lze proti takov\u00e9mu rozhodnut\u00ed podat&nbsp;<strong>spr\u00e1vn\u00ed \u017ealobu<\/strong>&nbsp;\u2013 tedy \u017ealobu k p\u0159\u00edslu\u0161n\u00e9mu spr\u00e1vn\u00edmu soudu. P\u0159\u00edslu\u0161n\u00fd je spr\u00e1vn\u00ed soud (krajsk\u00e9 soudy \u010di M\u011bstsk\u00fd soud v Praze), v jeho\u017e obvodu s\u00eddl\u00ed spr\u00e1vn\u00ed org\u00e1n prvn\u00edho stupn\u011b. Lh\u016fta pro pod\u00e1n\u00ed spr\u00e1vn\u00ed \u017ealoby je 2 m\u011bs\u00edce od doru\u010den\u00ed rozhodnut\u00ed St\u00e1tn\u00edho pozemkov\u00e9ho \u00fa\u0159adu.&nbsp;<\/p>\n\n<p>Rozsah soudn\u00edho p\u0159ezkumu v\u0161ak bude&nbsp;<strong>omezen\u00fd<\/strong>. Spr\u00e1vn\u00ed soud se nebude zab\u00fdvat vhodnost\u00ed konkr\u00e9tn\u00edho zvolen\u00e9ho \u0159e\u0161en\u00ed v pozemkov\u00fdch \u00faprav\u00e1ch (tedy zda by m\u011bl \u017ealobce z\u00edskat v pozemkov\u00e9 \u00faprav\u011b jeden konkr\u00e9tn\u00ed pozemek nebo jin\u00fd). Spr\u00e1vn\u00ed soud p\u0159ezkoum\u00e1 rozhodnut\u00ed o schv\u00e1len\u00ed n\u00e1vrhu pozemkov\u00fdch \u00faprav z hlediska jeho p\u0159im\u011b\u0159enosti (cena, rozloha, vzd\u00e1lenost pozemk\u016f), a bude zkoumat \u0159\u00edzen\u00ed z hlediska p\u0159\u00edpadn\u00fdch nam\u00edtan\u00fdch procesn\u00edch vad.&nbsp;<\/p>\n\n<p>Proti rozhodnut\u00ed spr\u00e1vn\u00edho soudu lze podat&nbsp;<strong>kasa\u010dn\u00ed st\u00ed\u017enost<\/strong>&nbsp;k Nejvy\u0161\u0161\u00edmu spr\u00e1vn\u00edmu soudu, a to do 14 dn\u016f od doru\u010den\u00ed rozhodnut\u00ed spr\u00e1vn\u00edho soudu. Jedn\u00e1 se o mimo\u0159\u00e1dn\u00fd opravn\u00fd prost\u0159edek proti pravomocn\u00e9mu soudn\u00edmu rozhodnut\u00ed. Nelze v n\u011bm uplat\u0148ovat jak\u00e9koli nov\u00e9 skute\u010dnosti. V \u0159\u00edzen\u00ed p\u0159ed Nejvy\u0161\u0161\u00edm spr\u00e1vn\u00edm soudem je povinn\u00e9 zastoupen\u00ed advok\u00e1tem. V krajn\u00edch p\u0159\u00edpadech, je-li st\u011b\u017eovatel p\u0159esv\u011bd\u010den, \u017ee do\u0161lo pozemkovou \u00fapravou k z\u00e1sahu do jeho \u00fastavn\u011b zaru\u010den\u00fdch pr\u00e1v (typicky do jeho vlastnick\u00e9ho pr\u00e1va dle&nbsp;<a href=\"https:\/\/next.codexis.cz\/legislativa\/CR958_2021_10_01?shareToken=3b45c1fe7c8e4bc6ecc3cf3c#unit-70\" rel=\"noreferrer noopener\" target=\"_blank\">\u010dl. 11<\/a>&nbsp;\u010di pr\u00e1va na soudn\u00ed ochranu dle&nbsp;<a href=\"https:\/\/next.codexis.cz\/legislativa\/CR958_2021_10_01?shareToken=3105d87ad1ba9801fa2add8a#unit-181\" rel=\"noreferrer noopener\" target=\"_blank\">\u010dl. 36<\/a>&nbsp;Listiny z\u00e1kladn\u00edch pr\u00e1v a svobod), lze do 2 m\u011bs\u00edc\u016f od doru\u010den\u00ed rozhodnut\u00ed Nejvy\u0161\u0161\u00edho spr\u00e1vn\u00edho soudu podat&nbsp;<strong>\u00fastavn\u00ed st\u00ed\u017enost<\/strong>&nbsp;k \u00dastavn\u00edmu soudu. Zde je op\u011bt povinn\u00e9 zastoupen\u00ed st\u011b\u017eovatele advok\u00e1tem.<\/p>\n\n<p>V samotn\u00e9m spr\u00e1vn\u00edm \u0159\u00edzen\u00ed lze d\u00e1le podat&nbsp;<strong>n\u00e1vrh na obnovu \u0159\u00edzen\u00ed<\/strong>, pop\u0159.&nbsp;<strong>podn\u011bt k na\u0159\u00edzen\u00ed p\u0159ezkumu rozhodnut\u00ed<\/strong>. Obnova \u0159\u00edzen\u00ed p\u0159ich\u00e1z\u00ed v \u00favahu zejm. tehdy, objev\u00ed-li se d\u0159\u00edve nezn\u00e1m\u00e9 skute\u010dnosti nebo d\u016fkazy, kter\u00e9 existovaly v dob\u011b p\u016fvodn\u00edho \u0159\u00edzen\u00ed a kter\u00e9 \u00fa\u010dastn\u00edk, jemu\u017e jsou ku prosp\u011bchu, nemohl v p\u016fvodn\u00edm \u0159\u00edzen\u00ed uplatnit. \u00da\u010dastn\u00edk \u0159\u00edzen\u00ed m\u016f\u017ee podat \u017e\u00e1dost o obnovu \u0159\u00edzen\u00ed do 3 m\u011bs\u00edc\u016f ode dne, kdy se dozv\u011bd\u011bl o d\u016fvodu obnovy \u0159\u00edzen\u00ed, nejpozd\u011bji v\u0161ak do 3 let od pr\u00e1vn\u00ed moci rozhodnut\u00ed.&nbsp;<\/p>\n\n<p>Podn\u011bt k proveden\u00ed p\u0159ezkumn\u00e9ho \u0159\u00edzen\u00ed lze podat obecn\u011b proti pravomocn\u00e9mu rozhodnut\u00ed spr\u00e1vn\u00edho org\u00e1nu. Na proveden\u00ed p\u0159ezkumn\u00e9ho \u0159\u00edzen\u00ed v\u0161ak nen\u00ed n\u00e1rok. P\u0159ezkoum\u00e1vaj\u00ed se ta rozhodnut\u00ed o pozemkov\u00fdch \u00faprav\u00e1ch, u nich\u017e lze d\u016fvodn\u011b pochybovat o jejich souladu s pr\u00e1vn\u00edmi p\u0159edpisy. Usnesen\u00ed o zah\u00e1jen\u00ed p\u0159ezkumn\u00e9ho \u0159\u00edzen\u00ed lze vydat nejd\u00e9le do 2 m\u011bs\u00edc\u016f ode dne, kdy se p\u0159\u00edslu\u0161n\u00fd spr\u00e1vn\u00ed org\u00e1n o d\u016fvodu zah\u00e1jen\u00ed p\u0159ezkumn\u00e9ho \u0159\u00edzen\u00ed dozv\u011bd\u011bl, nejpozd\u011bji v\u0161ak do 1 roku od pr\u00e1vn\u00ed moci rozhodnut\u00ed ve v\u011bci.&nbsp;<\/p>\n\n<p>V p\u0159\u00edpad\u011b, \u017ee Va\u0161e pozemky maj\u00ed b\u00fdt dot\u010deny pozemkovou \u00fapravou, doporu\u010dujeme co nejd\u0159\u00edve kontaktovat kvalifikovan\u00e9ho advok\u00e1ta.
